Shape Shifter v. Fenway Health: Latest US Detransitioner Court Case Exposes Faults with “Gender-Affirming Care.”

Shape Shifter v. Fenway Health, an emergent court case in Massachusetts, is part of a growing number of legal challenges by detransitioners against “gender-affirming care” providers. This case, brought by lawyer Mitra N Forouhar, exposes the lack of comprehensive patient evaluation, accurate diagnosis, and adherence to established safety protocols for patients seeking medical transition. It also highlights the need for providers to consider the holistic well-being of their patients, respecting their rights and
individual experiences.

Shape Shifter was a very gender non-conforming child and experienced same-sex attraction to other males before puberty. Unfortunately, parental disapproval and bullying in school made Shape Shifter struggle with self-acceptance. This ultimately led Shape Shifter to internalize a belief that he was “not masculine enough.” Upon encountering transgender ideology in graduate school, Shape Shifter saw transitioning as a path to liberate himself from the torment he had endured as an effeminate gay man. Shape Shifter began to medically transition in his early 20s and had facial feminization surgery, breast implants, orchiectomy, vaginoplasty, and several follow-up surgeries related to the vaginoplasty. However, after all of these interventions, Shape Shifter realized that his underlying issues, particularly internalized homophobia, persisted.

According to the lawyer’s Complaint Summary:

Fenway Health, a federally funded clinic, knowingly and willfully removed safety procedures, known as “gate-keeping”, from its transgender healthcare practice. This decision was not supported by any scientific evidence, to the contrary, Fenway was pursuing its goal of acquiring more transgender patients by responding to the demands of activists who felt that the safety protocols were “needless gate-keeping.” The lawsuit asserts that based on this new policy, Shape Shifter was rapidly medicalized, and his sexual orientation and symptoms of internalized homophobia were treated with deliberate indifference. Under the “gate-keeping” model of care internalized homophobia is a contra-indicator to transition, because studies have identified it as the leading cause of transition regret. The lawsuit alleges that under Fenway’s undifferentiated care and undue influence Shape Shifter underwent a number of surgical procedures and fully transitioned. Shape Shifter should have been treated for internalized homophobia, instead he was converted to transgender. The lawsuit alleges that Fenway’s apathetic attitude toward Shape Shifter’s sexual orientation and its associated distress violated his civil rights, and caused him irreversible, irreparable physical and mental injury. As a result of transitioning, he cannot and will never be able to express himself as a gay man. He must live with dissonance between who he is and how he appears.
